BACKGROUND

On August 3, 2018, Plaintiffs Ronillo C. Cortina (Cortina), Felix A. Panel and Marlene Panel (the Panels), Rodel A. Pacia (Pacia), Janine Fabro and Keir J. Fabro (the Fabros), Roberto De Guzman (De Guzman) (collectively, Plaintiffs) filed a verified complaint against Defendant Melencio Fajardo Jr. (Defendant) and Does 1 through 10, alleging: (1) breach of contract; (2) breach of the implied warranty of habitability; (3) breach of the implied warranty of quiet enjoyment; (4) failure to provide relocation assistance in violation of the Los Angeles Municipal Code (L.A.M.C.) sections 151.09 and 152 et seq.; (5) illegal collection of rent in violation of L.A.M.C. section 151.05; (6) negligence; (7) fraud by intentional misrepresentation; and (8) intentional infliction of emotional distress.

After default was entered against him and later set aside stipulation, Defendant filed an unverified answer on January 29, 2019. Plaintiffs did not demur to or otherwise challenge the answer
