TENTATIVE RULING
Defendant BANK OF AMERICA, N.A. (“BANA”) moves for summary judgment in its favor on the first cause of action of Plaintiff EDWARD RANDOLPH DAYTON’s first amended complaint. Plaintiff has not filed opposition.
Request for Judicial Notice. Matters subject to judicial notice may support a motion for summary judgment. (Code Civ. Proc. § 437c, subd. (b)(1).) BANA requests judicial notice of several recorded documents pertinent to this wrongful foreclosure action. The court takes judicial notice of all proffered recorded documents as facts not reasonably subject to dispute and capable of ready and accurate determination. (Ev. Code § 452, subd. (h); Md. Casualty Co. v. Reeder (1990) 221 Cal.App.3d 961, 977.) The court takes judicial notice of the fact of the documents’ existence, their recordation, and their legal effect. (Scott v.
