The motion is granted based upon an attorney affidavit of default. The Court exercises its discretion to grant relief based upon “mistake, inadvertence, surprise, or excusable neglect.”
Relief is conditioned upon the following: Defendant’s actual answer must be filed (i.e. not merely lodged as it is now) within ten court days of the hearing on this motion.
