This case arises from the Plaintiff’s claim that the Defendant has breached an agreement to pay amounts due and owing in invoices for diagnostic services provided by the Plaintiff to the Defendant. Trial is set for July 31, 2017.
This hearing concerns the motion of a third party, Robert Suer, for a protective order that would bar the Plaintiff, Kan-Di-Ki, LLC, from threatening to sue him or for seeking a contempt proceeding. This is his second request for a protective order. Robert Suer had previously requested a protective order until he could obtain guidance from the Delaware Chancery Court about the effect of an injunction on his ability to testify at a deposition. The Court denied the first request on December 2, 2016 because Robert Suer has not shown good cause for the order.
