Demurrer to Cross-Complaint
The Cross-Complaint alleges as follows: Cross-Complainants purchased property that contains an easement for ingress and egress for use in common with others. This easement burdens the property of other neighbors and has the function of providing access to the Cross-Complainants’ property and adjacent properties. The Cross-Defendant has exceeded the use by parking on the easement and by allowing guests to park on the easement. In addition, the Cross-Defendant has interfered with the easement by extending her driveway and adding drain gutters that encroach on the easement.
In addition, the Cross-Complainants have a prescriptive easement on the Cross-Defendant’s property to park.
