Petition of defendant Long Z. Liu to vacate arbitration award is denied. Defendant has failed to establish that the arbitrators exceeded their powers in their determination of the scope of the issues subject to arbitration or that the arbitrators refused to hear evidence material to the controversy decided.

Defendant argues the award must be vacated because the arbitrator refused to rule on the issue of legal malpractice based upon the misperception that the court ordered the issue of malpractice to arbitration. The court’s April 8, 2016 order stated "The court further finds that plaintiff has failed to establish that there are other issues not subject to arbitration which are part of this action and the determination of which in this case would make arbitration unnecessary, pursuant to CCP section 1281.2." In the April proceeding, plaintiff failed to explain how participation in an arbitration (agreed to by the parties) of the dispute as to whether the fees charged were unreasonable,
