The First Amended Complaint alleges as follows: the Defendants negligently constructed a wall that trespass on the Plaintiffs’ property. The Plaintiffs suffered damages because the wall disrupted the flow of water.
In addition, the Defendants did not obtain the required permits to build the wall. The City of La Canada sent notices of violation to the Plaintiffs because the wall was located on the Plaintiffs’ property. The Plaintiffs seek a declaration regarding the rights and duties of the parties with regards to the wall and indemnity for the costs to remove the wall and bring their property into compliance with building codes. On September 27, 2016, the Court consolidated the Plaintiffs’ claims in EC064979 with the claims in EC0961923 and designated EC061923 as the lead case.
