Defendant Brown Construction, Inc.’s unopposed motion to compel further responses to form
interrogatories for construction litigation, set one, special interrogatories, set one, and request for
production of documents, set one, is GRANTED. (Code Civ. Proc., §§ 2030.300, 2031.310;
Decl. of Stephen R. McCutcheon, Jr., ¶ 7, Exh. G.) Plaintiff Patrick Donohue dba Donohue
Construction shall provide further verified responses to all discovery requests at issue, together
with all responsive documents, without objections, by August 9, 2018.
Defendant’s request for monetary sanctions against plaintiff is GRANTED in the amount of
$2,090.00. (Code Civ. Proc., § 2023.010, subds. (d), (e), (f); Decl. of Stephen R. McCutcheon,
Jr., ¶ 10; Decl. of Christopher W. Moores, ¶ 3.)
If no hearing is requested, this tentative ruling is effective immediately. No formal order
pursuant to California Rule of Court 3.1312, or further notice is required.
