RULING

The Demurrer of defendants Susannah C. Siddens and Shane B, Brentharn (collectively “defendants”) is SUSTAlNED with leave to amend.

BACKGROUND

This case arises out of defendants’ tenancy in a residential home owned by plaintiff Michael Partow (“plaintiff’ or “Mr. Partow”), Defendants moved out and plaintiff is suing them for breach of lease. Mr. Partow attributes damages to defendants’ conduct an amount exceeding $70,000 characterized as “diminution of value" to the home. Although the demurrer addresses four causes of action (breach of contract, property damages, slanderous comments, and fraud), the attached complaint only asserts a cause of action for breach of contract.
