The demurrer of defendant Marin General Hospital is sustained and the motion for judgment on the pleadings of defendant Arun Raghupathy, MD, is granted, with leave to amend as to plaintiff Ginu Gray and without leave to amend as to plaintiff Myrna Menjivar-Gray‘ The court found previously in connection with the demurrer of defendant Benedict P. Ancock, M.D., that Plaintiffs fail to allege facts sufficient to constitute a cause of action for reckless infliction of emotional distress. The court has given Gray an opportunity to amend. It found no reasonable possibility that Menjivar-Gray will be able to amend to state a cause of action.
