RULING
Defendant/Cross-Complainant Beach Street Builder’s (BSB) motion contesting the Application of cross-defendant Todd Morris Fire Protection, Inc, for determination that its settlement with plaintiff is in good faith, is granted, (Code Civ. Proc. § 877.6 (a)(2).)
In its Application, Todd Morris states that Plaintiff has agreed to accept $10,000, and in return, “PLAINTIFF will dismiss Todd Morris from “all of Plaintiff’s respective claims, with prejudice, in exchange for said payment to PLAINTIFF, the settling parties will bear their own attorney’s fees and costs, and agree to a waiver of Civil Code § 1542, in addition to the standard settlement terms and conditions. (McLain Decl. 11 3.)” (MFA p. 2-3, emphasis added.)
