Plaintiff operates four fuel dispensing stations in San Luis Obispo County. Plaintiff’s petition for writ of mandate and damage claims arise from an administrative decision upholding four Unilateral Enforcement Orders issued by the County against Plaintiff. The Enforcement Orders assert violations of laws and regulations governing underground storage tanks and the handling of hazardous materials. Fines in the amount of $1,412,355 were assessed.

Plaintiff challenged the validity of the enforcement orders. Over a period of several days, administrative hearings were conducted by an administrative law judge (ALJ) from the Office of Administrative Hearings under the Administrative Procedures Act.
