PLAINTIFF'S MOTION FOR RELIEF FROM STAY
TENTATIVE RULING:
Plaintiff FCE BENEFIT ADMINISTRATORS, INC.’s Motion for Relief from Stay is DENIED. The underlying Department of Labor case, U.S. Department of Labor v. Chimes District of Columbia, Inc., U.S. District Court for the District of Maryland, Case No. 1:15-cv-03315-RDB, has not yet concluded. This Court has previously found that a stay was warranted “because it promotes judicial economy. While it is not mandatory to stay this action, it appears logical to do so. There may be decisions made on questions of fact in the underlying case that are necessary to the resolution of this case – for example ACE’s obligation to defend in light of possible exclusions.” (See Minute Order dated February 14, 2017.) These circumstances have not changed. Accordingly, Plaintiff’s motion for relief from stay is denied.
Defendant HEFFERNAN INSURANCE BROKERS’ Request for Judicial Notice is GRANTED as to Exhibits 6-9.
