PLAINTIFF ROBERT MARSILI's Motion To Vacate Dismissal Pursuant To Code Of Civil Procedure 473

Plaintiff Robert Marsili's CCP §473(b) motion to vacate dismissal is granted, with conditions. California has a "strong public policy favoring disposition on the merits." (Bahl v. Bank of America (2001) 89 Cal.App.4th 389, 398.) Plaintiff's attorney Andrew Dimitriou declares under penalty of perjury: "I was solely to blame for the failure to file the amended complaint and resulting dismissal." Thus, Dimitriou shall (1) file the amended complaint on or before March 18, 2020 and (2) pay- on or before April 1, 2020 - $10,377 to Goodman Neuman Hamilton LLP and $7,020 to Chapman Law Group, APC for "reasonable compensatory legal fees and costs." (See CCP §473(b).)
