1. Background Facts
Plaintiff, Mary Lozano filed this action against Defendant, Providence Health & Services, Inc. for damages arising out of a trip and fall. Plaintiff alleges she sustained a left shoulder fracture as a result of the fall.
2. Deposition Subpoena
On 7/11/16, Defendant propounded a deposition subpoena for production of business records on Plaintiff’s employer, Community Legal Services. The subpoena sought production of “any and all” of Plaintiff’s employment records, regardless of date, and then listed various categories of documents that should be included for production.
3. Motion to Quash
Plaintiff, believing the subpoena was overbroad, commenced meet and confer efforts. The parties, unfortunately, were not able to come to a resolution of the issues relating to the motion.
