For the reasons that follow, the court’s tentative ruling is to GRANT the motion to compel discovery and GRANT the motion for sanctions in an amount to be determined at the hearing.
The rules that govern this discovery motion are as follows. If a party to whom interrogatories or document requests were directed fails to serve a timely response, the propounding party may move for an order compelling responses and for monetary sanctions. (Code Civ. Proc., §§ 2030.290, subds. (b)-(c), 2031.300, subds. (b)-(c).) With respect to untimely responses to requests for admission, the propounding party may move for an order that the truth of any matters specified in the requests be deemed admitted. (Code Civ. Proc., §§ 2033.280, subd. (b).) Further, failing to respond within the statutory time frames waives all objections to the discovery being propounded including claims of privilege and work product. (Code Civ. Proc., §§ 2030.290, subd. (a), 2033.280, subd. (a).)
