PLAINTIFF'S MOTION TO ENFORCE SETTLEMENT IS DENIED, WITHOUT PREJUDICE.

Background

On September 7, 2018, Plaintiff Moises Lopez filed the instant action against Defendants Juan Hernandez Flores, Jose Hernandez, Arturo Rodriguez, and Does 1 through 20. The Complaint asserts causes of action for:

Partition; and

Accounting.

On December 20, 2018, default was entered as to Jose Hernandez and on February 13, 2019, default was entered as to Arturo Rodriguez. On May 29, 2019, the Court granted Plaintiff’s motion for summary adjudication of the first cause of action for partition by sale. On August 20, 2019, the Court held an OSC re: Appointment of Referee. At the hearing, Plaintiff informed the Court that the case was close to settling. On October 17, 2019, a Notice of Settlement of Entire Case was filed. On February 10, 2020 the Court granted the Stipulation and Order re: Dismissal and Retention of Jurisdiction entered into by Plaintiff and Juan Hernandez Flores (hereinafter “Defendant”).
