Receiver Blake C. Alsbrook’s Motion for Order Rejecting Fraudulent Lease is DENIED; however, the court shall discuss the apportionment of fees with the parties at the hearing on this motion.

MOTION TO REJECT FRAUDULENT LEASE

The Receiver moves for this court to declare invalid a five-year lease between Braithwhite as landlord and his sister, Tuckiesha Braithwhite, as tenant, for a unit at 805 Temple Terrace in Los Angeles, on the grounds that the lease was entered into four days before this action was filed, and for $1,845-per-month less than the unit’s reasonable market value ($850 as opposed to $2,695). (Alsbrook Decl. ¶¶ 8–10.) The Receiver represents that an unlawful detainer action was filed against Tuckiesha by the previous receiver, but the court there declined to rule on the validity of the lease as Tuckiesha had not had an opportunity to be heard in this proceeding.
