Background
On August 13, 2018, Plaintiff Ternesha Peoples (“Plaintiff”) filed the instant action against Defendants Tessie Cleveland Community Services Corp. (“TCCSC”) and Christie Barboza (“Barboza”). On January 8, 2019, Plaintiff filed a Motion for Leave to File Third Amended Complaint (“TAC”). On January 28, 2019, the Court granted Plaintiff’s motion for leave to file TAC in part, permitting Plaintiff to file a TAC adding a cause of action for professional negligence, and denying Plaintiff’s motion as to the addition of punitive damage claims on the grounds that Plaintiff failed to submit supporting affidavits establishing that there is a substantial probability she will prevail on her claims. On February 14, 2019, the TAC was filed, asserting causes of action for:
Intentional Infliction of Emotional Distress;
Violation of California Civil Code § 43;
Violation of California Civil Code § 51.7;
