DEMURRER

MOTION TO STRIKE PUNITIVES

[CCP §430.10 et. seq.]

Date: 2/15/19

Case: Spears v. Pasadena Christian School (BC716195)

Tentative Ruling:

Defendants Pasadena Christian School, Steven Gray, and Pauline Tkcharkhoutian’s Demurrer to Plaintiffs’ Complaint is sustained in part and overruled in part as follows:

Demurrer to the first cause of action for negligence is sustained, with leave to amend, as to the individual defendants Steven Gray and Pauline Tkcharkhoutian on the ground the pleading fails to allege any duty owed or negligent conduct engaged in by these individual defendants. (See Ladd v. County of San Mateo (1996) 12 Cal.4th 913, 917.) The demurrer to the first cause of action as to defendant Pasadena Christian School is overruled, as the complaint sufficiently alleges plaintiffs Jean Spears and Walter Spears were “harmed financially and emotionally.” (Complaint para. 8.) ........
