RULING
The demurrer by defendant Acadia Healthcare Company, Inc., a Delaware corporation, doing
business as Bayside Marin Treatment Center (“Bayside” or “Defendant”) to the second amended
complaint (“SAC”) of plaintiff Patricia Calazans (“Plaintiff”) is OVERRULED. (Code Civ.
Proc. § 430.10(e), (£).)
Defendant’s motion to strike is DENIED.
Factual and Procedural Background
This action arises out of the alleged sexual assault and ultimate death of Daniel Simoes
(“Simoes”) who was an inpatient at Defendant’s residential health facility for addiction issues.
