Background

Plaintiff Harry P. Hewell (“Plaintiff”) filed a complaint on July 12, 2017, alleging two causes of action for medical malpractice and gross negligence. On August 30, 2018, Defendants The Regents of the University of California (“Regents”), Simon Law M.D. (“Law”), and Kouros Nouri-Mahdavi, M.D. (“Nouri-Mahdavi”) (collectively “Defendants”) filed a demurrer to the complaint. Plaintiff filed an opposition on October 15, 2018. Defendants filed a reply on October 16, 2018.

Plaintiff’s complaint arises from medical negligence related to the prescription of two separate eye drops. On May 1, 2017, Plaintiff visited the UCLA Jules Stein Eye Institute (“Stein”) for an examination. Law examined Plaintiff’s eyes and diagnosed him with glaucoma.
