Plaintiff David Lamden (“Plaintiff”) commenced this action against Defendants Keller Williams Realty, Inc. dba Keller Williams Beverly Hills Realty (“Realty”) and Sal Tutone (“Tutone”) (collectively “Defendants”) on July 11, 2018. The operative pleading is the First Amended Complaint (“FAC”) filed on July 22, 2019. The FAC asserts causes of action for (1) breach of written contract and (2) negligent misrepresentation. In the FAC, Plaintiff alleges that he owns a residential estate in Beverly Hills and that Defendants negotiated a short-term rental agreement of the estate with him. Plaintiff alleges that Defendants negligently warranted that their unidentified high net worth client was a legitimate renter prompting Plaintiff to cancel future showings of the property.
