Complaint and Cross-Complaint

Plaintiff Bradley Guevara (“Plaintiff” or “Guevara”) filed a complaint on June 27, 2018, alleging claims for: (1) strict liability (Civ. Code § 3342); (2) strict liability (common law); and (3) negligence, arising from the death of his infant daughter, Gaia. Plaintiff alleges that on May 5, 2018, Gaia’s mother, Defendant/Cross-Complainant Jennifer Mae Van Buskirk (“Buskirk” or “Cross-Complainant”), left Gaia with Defendant Joaquin Bobadilla (“Joaquin”) and Defendant/Cross-Defendant Graciela Bobadilla (“Graciela”) at their residence on Benefit Street in Sherman Oaks, California, which was owned by Defendant/Cross-Defendant Arash Rajaeeyan (“Rajaeeyan” or “Cross-Defendant”). While babysitting, Graciela left Gaia unattended, and Joaquin and Graciela’s three dogs allegedly mauled Gaia, who passed away from the injuries.
