[TENTATIVE] ORDER RE: MOTION FOR SUMMARY JUDGMENT
On June 4, 2018, Plaintiff Eleanor Muraca (“Plaintiff”) filed this action against Defendants Michael Abraham Aleman, M.D. (“Dr. Aleman”), Kaiser Foundation Health Plan Inc., Kaiser Foundation Hospitals, Southern California Permanente Medical Group (collectively, “Kaiser”) for medical malpractice arising out of treatment rendered between May 2018 and July 2017, leading to surgery in August 2017.
Defendants move for summary judgment. Plaintiff seeks a 30-day continuance of the hearing on this Motion on grounds her retained medical expert requires additional time to review the voluminous medical records and to render an opinion as to standard of care. Further, Plaintiff passed away on April 20, 2019 and her autopsy report needs to be reviewed by her retained expert. The executor of her estate and personal representative has moved to be substituted as Plaintiff.
