[TENTATIVE] ORDER RE: PLAINTIFF’S MOTION TO QUASH DEFENDANT’S SUBPOENA FOR RECORDS
On May 10, 2018, Plaintiffs Hodaya Elefant and Miriam Citronenbaum (collectively, “Plaintiffs”) filed this action against Defendants Cedars-Sinai Medical Center and Laura Lynn Perreira (“Perreira”) (collectively, “Defendants”) for medical malpractice. When Plaintiff was 39 weeks pregnant, she elected to induce labor. Plaintiff alleges that Perreira, a nurse midwife, negligently used excessive force while inserting an intrauterine pressure catheter which resulted in placental trauma and necessitated an emergency C-section.
On March 1 ,2019, Defendants served deposition subpoenas for production of business records on Rockland Community College, Chamberlain University, and Devry, out-of-state schools that Plaintiff attended and received nursing degrees from. The subpoenas sought “[a]ll academic records, attendance records, grades, school physicals, medical records, student transcripts, courses or classes
