RULING ON MOTION OF DEFENDANT 7555 DeLONGPRE LLC FOR SUMMARY JUDGMENT AS TO PLAINTIFF’S FIRST AMENDED COMPLAINT

BACKGROUND: Action for breach of warranty of habitability, etc. -

TIMELINE:

On/about 1/10/14: Plaintiff [tenant] entered into a lease agreement with

Def 7555 DeLONGPRE LLC [landlord] for an apartment in L.A. Plaintiff alleges that he began to experience allergic reactions and fatigue immediately upon moving into the property

o/a 1/6/16: Plaintifff texted def DeLONGPRE’s property mgr., Mr. Goor,

re alleged mold in the bathroom. Defendant claims that Mr. Goor

inspected and didn’t find mold, but determined there was water damage and hired a plumber to remedy that damage. Plaintiff claims that

defendant’s failure to inspect for or remediate mold at that time was a breach of defendant’s warranty of habitability, etc.
