Pacific Gas and Electric Company’s Motion for Prejudgment Possession of Property is granted pursuant to Code of Civil Procedure section 1255.410.
The court finds that plaintiff is entitled to acquire the property described in the complaint by eminent domain, and to take possession of the property. The court finds that plaintiff has deposited an amount of just compensation as required under Code of Civil Procedure section 1255.010. Finally, the court finds that there is an overriding need for plaintiff to possess the property prior to issuance of the final judgment in this matter, and that plaintiff will suffer a substantial hardship if the motion for possession is denied, that outweighs any hardship to defendants if the motion is granted.
