STATEMENT OF MATERIAL FACTS AND/OR PROCEEDINGS:
This is a legal malpractice action. Plaintiff alleges that it hired Defendants to represent it in an arbitration and that Defendants breached their duty of care by using an unqualified expert whose testimony was given no weight by the arbitrator, resulting in Plaintiff’s recovery of only a nominal amount of damages in the arbitration.
Defendants move for summary judgment.
TENTATIVE RULING:
Defendants Donnaldson & Callif, LLP and Michael C. Donaldson’s motion for summary judgment is DENIED.
