Defendants Jane Chung and the Law Offices of Jane Chung’s Motion for Order re: Allocation of Arbitration Fees and Costs is DENIED.

Chung asks this court to reverse the ruling of an arbitrator declining to apportion arbitration fees and costs between Chung and Park on a pro-rata basis according to Code of Civil Procedure § 1284.2. (Motion at p. 9.) Chung reasons that the rule announced in Armendariz requiring employers to bear the costs of arbitration of non-waivable statutory claims does not apply to Park’s common-law claims against Chung. (Motion at pp. 6–9.) Park in turn questions whether this court has jurisdiction to rule on the motion, and argues that this court already decided the issue in granting the petition to compel arbitration.
