I. Background
Plaintiffs Ottmar Benavides, Diana Maruri, and Nathan Benavides, a minor, stayed at defendant LA Crystal Hotel’s property and were allegedly bitten by bedbugs. Nathan Benavides allegedly has a medical condition making him especially susceptible to infection. Plaintiffs alerted the hotel staff and a manger accompanied them to their room, inspected it, and declared that the bedbugs were actually baby cockroaches. Plaintiffs left the hotel to try and find other accommodations, failed, and upon return attempted to show the front desk employees pictures of the bedbug bites and infestation. The manager allegedly became angry and asked them to immediately check out. Plaintiffs left the hotel and went to the emergency room.
The case was dismissed on November 19, 2018. Plaintiffs filed a motion to set aside the dismissal on May
