BACKGROUND

Plaintiff Arcelia Garibay (“Plaintiff”) alleges that on January 17, 2017, Plaintiff suffered personal injuries when she tripped and fell on a wooden board used as a step on property owned, maintained, or operated by defendant Tony’s Auto Parts, Inc. (“Defendant”).[1] Plaintiff brings causes of action for Premises Liability and General Negligence against Defendant.

Defendant moves for summary judgment against Plaintiff’s complaint. Plaintiff opposes[2] the motion, and Defendant has replied.
