MOTION TO BE RELIEVED AS COUNSEL FOR PLAINTIFFS IS GRANTED.

Paul T. Dye of Reiter Dye & Brennan LLP, attorney of record for Plaintiffs Cesar and Tatiana Romero, seeks to be relieved on the grounds that the attorney-client relationship has broken down and cannot be re-established. Counsel asserts that it is unreasonably difficult for counsel to carry out the employment effectively. Counsel further contends that the Romeros have breached material terms of the Retainer Agreement. Additionally, Counsel argues that his firm is a 2 lawyer firm and one of the lawyer’s health condition renders it unreasonably difficult to carry out the representation effectively.

Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted. (People v. Prince (1968) 268 Cal.App.2d 398, 406.) The Court has reviewed Plaintiffs’ response to the motion and finds that the arguments provided are insufficient to warrant a denial of the Motion. The Court notes that trial is schedule
