Background
On March 29, 2018, Plaintiff Martha Machado filed a First Amended Complaint (“FAC”) against Defendants Helen Grace Chocolates, LLC (“HGC”), BFC Financial Corporation (owner of HGC), Eastey Enterprises, Inc., and Engage Technologies, Inc. Plaintiff’s hand was caught in a shrink-wrap machine. She and fellow employees subsequently had difficulty locating the emergency shut-off button. Plaintiff brought causes of action for:
General Negligence;
Strict Products Liability;
Negligent Products Liability;
Breach of Implied Warranty of Merchantability;
Fraudulent Concealment; and
Battery.
On December 20, 2018, this court approved a good faith settlement between Plaintiff and Defendants Helen Grace Chocolates and BFC Financial Corporation.
