DEFENDANT’S Motion for Leave to Designate Experts Late
Background
Defendant City of Los Angeles (“Defendant”) moves for leave to untimely designate expert witnesses. Plaintiff Marion Ring (“Plaintiff”) opposes the motion.
This matter was originally set for trial on April 4, 2018. On January 23, 2018, Plaintiff served on Defendant a demand for the exchange of expert witnesses. On March 1, 2018, Defendant served its designation of experts. Plaintiff moved to exclude Defendant’s experts as they were untimely designated. On April 5, 2018, the Court granted Plaintiff’s motion.
On March 13, 2018, the Court continued the trial to June 13, 2018. On May 17, 2018, a stipulation to continue trial was filed continuing trial to September 2, 2018. The parties agreed that the discovery and all motion cutoffs would not be based on the new trial date.
