Defendants' Demurrer to the Second Amended Complaint is overruled as to the 8th Cause of Action (Consumer Legal Remedies Act) and is granted with leave to amend as to the 9th Cause of Action (Business and Professions Code Section 17200 and 17500).
Defendants' Request for Judicial Notice is granted as to Exhibit A-C. The Request is denied as to the remaining Exhibits.
As to the 8th Cause of Action, the First Amended Complaint alleges that Plaintiff's injuries were caused when the cab driver accelerated. The Second Amended Complaint alleges that Plaintiff's injuries were caused by the violations under the Consumer Legal Remedies Act, without which Plaintiffs would never have entered this cab. There is no contradiction in the pleading.
As to the 9th Cause of Action, Plaintiffs allege that "Defendants misrepresented to the public and the plaintiffs on their website" that they had sufficient GPS tracking. However, the Second Amended Complaint does not state........
