DEMURRER TO PLAINTIFFS’ FIRST AMENDED COMPLAINT

Background
On September 9, 2016, Plaintiff BETTY TANSAVATDI (“Plaintiff”) filed a complaint, alleging causes of action against Defendants DARYL FLOOD WAREHOUSE AND MOVERS, INC. and KEVIN TROY BOX (“Defendants”) for: (1) negligence; and (2) negligent hiring, retention, supervision, or training.
This action arises out of the alleged wrongful death of Pissanuk Jonathan Tansavadti (“Decedent”). Decedent is alleged to have died after being hit by Defendants’ tractor-trailer. Plaintiff alleges that Decedent’s death was the result of Defendants’ negligence.
On November 18, 2016, Defendants filed a demurrer to the complaint. On December 12, 2016, Plaintiff filed her first amended complaint. On January 20, 2017,
