Plaintiff, Daniel Muller filed this action against Defendants, Fitness International, LLC and Does 1-50 for damages arising out an attack by Doe Defendant, Aleksander Grigoriev on Fitness International’s premises.
At this time, Fitness International has agreed to settle with Plaintiff for $5,000 in exchange for a dismissal with prejudice. Fitness International seeks an order from the Court finding that the settlement is in good faith.
Fitness International timely and properly served the moving papers on all parties to the action. Any opposition to the motion was due on or before 1/22/18. As of 1/25/18, no party has filed opposition to the motion. The burden on a motion for determination of good faith settlement rests squarely on the party opposing the finding of good
