dEFENDANTS lIFOAM INDUSTRIES, LLC AND VERONICA SARRIA’S DEMURRER TO PLAINTIFF’S COMPLAINT.

The Demurrer is SUSTAINED without leave to amend as to the Fifth Cause of Action against Defendant Sarria and as to the Eighth Cause of Action against both Defendants. The Demurrer is OVERRULED as to the Second and Third Causes of Action, and as to the Fifth Cause of Action alleged against Defendant Lifoam.

Factual Background

This is a pregnancy discrimination action. The Complaint alleges as follows. Plaintiff Maribel Chairez (“Chairez”) alleges that she was employed by defendant Lifoam Industries, LLC (“Lifoam”) as a Machine Operator and Packer in August 2011. (Complaint ¶ 8.)
