#1 – Weissman, et al. v. Cooperative of American Physicians, Inc., et al. (BC 625 309); In re Mutual Protection Trust (16 STPB 02528)

On September 27, 2016 this court considered a Notice of Related Case filed by Plaintiffs/Petitioners Glenn H. Weissman, M.D., et al. on July 27, 2016 and determined that unlimited jurisdiction civil case BC625309 should be related with probate case 16STPB02528. The court found that the gravamen of both cases was the allegation that a group of people of a subservient entity was attempting to oust the trustees of the principal entity – contrary to law and to the terms of the trust – and therefore the court related the cases in the probate division because probate law courts have exclusive jurisdiction over the internal affairs of a trust. See, e.g., Probate Code §§ 17000, 17200; see also Saks v. Damon Raike & Co. (1992) 7 Cal. App. 4th 419, 430.
