I. Background

Plaintiffs Susan K. Lyons and Tom Chou, Ph. D. sued Defendants Lynn Coates, M.D. and Family Practice Associates of Carson for medical malpractice and negligence arising from Defendants’ allegedly negligent testing of Lyons for the herpes (HSV2) virus. Defendants’ mistaken representation to Lyons that she did not have the virus allegedly caused Lyons to transmit the disease to her sexual partner, Chou.

The medical malpractice claim is asserted on behalf of Lyons, while the negligence claim is asserted on behalf of Chou.
