The court finds that defendant has failed to establish in the moving papers a reasonable possibility it will obtain judgment in this action, and has failed to submit sufficient evidence which, if credited, would defeat the showing made by plaintiff in the opposition concerning the possibility of plaintiff obtaining judgment.
