MOVING PARTY: Plaintiff A-Fordable Billing Solutions, Inc.
OPPOSITION: Defendant Hi-Land Mountain Homes, Inc.
According to the allegations, on May 19, 2014, the parties entered into a written services agreement, whereby Plaintiff was to perform medical billing services for Defendant in exchange for fees. Shortly thereafter, Defendant terminated the agreement and refused to pay Plaintiff for the services it performed under the agreement.
On July 3, 2014, Plaintiff sued Defendant for breach of contract in LASC Case No. BC550342. On September 8, 2015, at mediation, the parties entered into a settlement agreement, providing a release by plaintiff in exchange for $62,500 paid in three installments by defendant. Defendant made only the first scheduled payment.
On December 23, 2015, Plaintiff filed a complaint for breach of settlement agreement, asserting a sole cause of action for breach of contract and praying for the $47,500, the alleged balance owed on the settlement agreement plus
