On November 6, 2015, Plaintiff Rozalia Szuta (“Plaintiff”) filed this action against Defendants Kenneth Goad and Modular Metals Fabricators, Inc. (“Defendants”). On September 30, 2016, Defendants served Plaintiff with Form Interrogatories, Set One; Special Interrogatories, Set One; and Demand for Production of Documents, Set One. Declarations of Bruce E. Todd, ¶¶ 2. Plaintiff has failed to provide any responses. Id., ¶ 6. Defendants now move to compel Plaintiff’s responses and request monetary sanctions.
If a party fails to serve a timely response to a demand for production or interrogatories, the party making the demand may move for an order compelling a response. Id., §§ 2030.290(b), 2031.300(b). The party to whom the demand or interrogatories are directed waives
