Bifurcation

The punitive damages claim will be bifurcated.
Assuming defendants’ net worth information has been properly requested but not yet produced, defendants are ordered to have that information readily available with counsel at any courthouse proceedings from the time that the jury begins its deliberations in the first phase. If the jury’s findings after the first phase make a second phase necessary, the Court will order the net worth information immediately produced to the plaintiff in order to proceed to the second phase as rapidly as practical. If a defendant does not have properly requested information immediately available – that is, literally at the courthouse when the jury’s verdict in the first phase is returned -- that will be a serious violation of this order that may warrant sanctions.
