1. Background Facts
Plaintiff, Corey Strand filed this action against Defendants, Edward L. Gross, Savoie Construction, Inc., Larry C. Bucher, Theresa L. Bucher, and the Bucher Family Trust for damages arising out of a fall into an excavated site on the Buchers’ property. Savoie is alleged to have been the general contractor on the project, and Gross is alleged to have been the concrete subcontractor on the project. Plaintiff was working as a plumbing contractor at the home when the fall occurred.
2. Undisputed Facts
The basic facts in connection with this motion are not disputed. Savoie was the general contractor, hired by the Buchers, to perform certain improvements on their home. Savoie hired Gross to perform concrete work and Plaintiff to perform plumbing work. While Plaintiff was on the property, he fell into an open hole allegedly left
