The Court finds the demurrer to the First Amended Complaint MOOT.
On March 23, 2015, Plaintiff Mei T. Leung (“Plaintiff”) filed a Complaint against Defendant City of Pasadena (“City”) and Does 1 to 10 for negligence and premises liability.
On June 13, 2017, Plaintiff filed a First Amended Complaint (“FAC”) for damages for statutory liability.
On August 30, 2018, Plaintiff filed an amendment substituting Green Street Venture, LLC (“Green”) for Doe 2.
On January 14, 2019 Green filed the instant demurrer to the FAC.
On January 30, 2019, Plaintiff voluntarily dismissed the Complaint as to defendant Green thereby making the demurrer MOOT.
Moving Party is ordered to give notice unless notice is waived.
