On August 9, 2013, Plaintiff Irma Escobar filed the instant action against Defendants Wells Fargo Bank, N. A. (“Wells Fargo”), Federal National Mortgage Association (“Fannie Mae”), and Ndex West, LLC. The third amended complaint (“TAC”) alleges breach of agreement and misrepresentation. Trial is set to commence on September 17, 2019.
On December 3, 2018, the Court granted Wells Fargo and Fannie Mae’s (“Defendants”) motion to compel Plaintiff’s Responses to Wells Fargo's Requests for Production Numbers 10-24. On January 31, 2019, Defendants filed the instant motion for terminating sanctions against Plaintiff for an alleged violation of that order. On February 20, 2019, Plaintiff filed a declaration apparently in response to this issue. Former counsel for Plaintiff also filed a declaration in connection with this motion.
