MOTION TO SET ASIDE DISMISSAL

Plaintiff’s requests the Court to set aside its dismissal entered on April 15, 2016. On May 26, 2016, the Court took Plaintiff’s request to set aside its dismissal off calendar because Plaintiff failed to appear for the hearing and failed to submit to the Court’s tentative ruling.
Plaintiff’s counsel states that he inadvertently failed to advise the Court that he was submitting to the tentative ruling. Plaintiff’s counsel formerly stated that Plaintiff’s counsel’s failure to appear at the Order to Show Cause Regarding Dismissal for Failure to Prosecute hearing on April 15, 2016 was also due to his excusable neglect.
