Background
On March 2, 2012, Plaintiff Ivan Rene Moore (“Plaintiff”) filed a complaint against Defendant Kimberly Martin-Bragg (“Defendant”). On June 28, 2012, Plaintiff filed a First Amended Complaint for (1) trespass to chattels; (2) conversion; (3) negligence, and (4) violation of Civil Code 1965.
Plaintiff alleged that Defendant obtained a fraudulent judgment of possession of Plaintiff’s home in an unlawful detainer action. Further, after obtaining the judgment for possession, Plaintiff alleges that Defendant took control of certain personal properties belonging to Plaintiff. Defendant’s unlawful detainer judgment was later reversed in full by the Court of Appeal of California. However, Plaintiff alleges that Defendant refused to return Plaintiff’s personal property to him, so Plaintiff filed the instant action for trespass to chattel and conversion of his property.
